Effective Date: December 1, 2025

This User Agreement and Public Offer (“Agreement”, “Public Offer”, “Terms”) governs the use of the DailyDoll Shop marketplace located at https://dailydoll.shop (“Marketplace”, “Platform”, “Website”, “DailyDoll Shop”, “we”, “us”, or “our”).

By accessing the Website, registering an account, placing an order, selling products, or otherwise using the Marketplace, the User agrees to be bound by this Agreement and all related policies published on the Platform.

If you do not agree with this Agreement, you must stop using the Website and Services immediately.

1. Basic Concepts

Website Visitor means a person who visits https://dailydoll.shop without necessarily placing an order.

User means an individual or legal entity using the Website who accepts this Agreement and may browse, register, buy, sell, or otherwise interact with the Marketplace.

Buyer means a User who has placed an order through the Marketplace.

Seller means an individual, sole proprietor, company, artisan, creator, or other legal entity whose products are listed for sale on the Marketplace.

Marketplace or Online Store means the Internet platform located at https://dailydoll.shop, where goods offered by Sellers are presented for purchase, together with payment, delivery, return, and other conditions.

Website means https://dailydoll.shop.

Seller’s Page means a page of the Website containing information about the Seller, products, delivery terms, return terms, shop policies, and other information necessary for the conclusion and execution of a sale and purchase agreement.

Goods means products presented for sale on the Website, including author dolls, collectible dolls, teddy bears and their friends, toys, miniatures, doll accessories, handmade items, workshops, patterns, digital goods, and related creative materials.

Order means the Buyer’s duly submitted request to purchase Goods selected on the Website and have them delivered to the address specified by the Buyer, or otherwise received according to the agreed delivery method.

Store Credit means a non-cash credit, coupon, or internal balance issued by the Platform or Seller, which may be used toward future purchases on the Marketplace according to the applicable terms.

2. General Provisions

2.1. This Agreement applies to the entire range of services offered through the Marketplace, including use through computers, mobile phones, tablets, mobile applications, and other devices.

2.2. DailyDoll Shop provides Users with access to the Marketplace, product catalogues, account tools, order tools, payment tools, seller tools, and related services according to this Agreement and applicable policies.

2.3. The Marketplace connects Buyers and independent Sellers. Unless expressly stated otherwise, DailyDoll Shop is not the manufacturer, owner, or direct seller of Goods listed by independent Sellers.

2.4. By ordering Goods through the Marketplace, the Buyer agrees to this Agreement, the applicable Seller terms, and all relevant Platform policies, including the Delivery Policy, Return Policy, Fees and Payments Policy, Privacy Policy, and other documents published on the Website or HelpDesk.

2.5. Information about Goods presented on the Website, together with this Agreement and applicable Seller terms, may constitute a public offer to the extent provided by applicable law.

2.6. This Agreement may be updated by DailyDoll Shop from time to time. Unless otherwise stated, the updated version becomes effective upon publication on the Website. Where legally required, Users may be notified of material changes in advance.

2.7. The Public Offer is considered accepted by the Website Visitor, User, or Buyer from the moment of registration, placement of an Order, use of the Services, or other clear acceptance of the Agreement.

2.8. A retail purchase agreement between the Buyer and the relevant Seller is considered concluded when the Order is accepted and payment is confirmed, unless applicable law or Seller terms provide otherwise.

2.9. By providing an email address, phone number, delivery address, or other contact details, the User agrees that such information may be used for order processing, delivery, service communications, customer support, fraud prevention, and legal compliance. Marketing communications may be sent only where permitted by applicable law and subject to consent or opt-out rights.

2.10. The Seller may involve third-party service providers for the fulfilment of obligations, including payment processors, delivery companies, fulfilment providers, and technical services, while remaining responsible for their own obligations to the Buyer where required by law.

2.11. DailyDoll Shop may provide information and technical support in connection with agreements concluded between Buyers and Sellers but does not automatically become a party to such sale agreements unless expressly stated.

3. Subject of the Agreement

3.1. The purpose of this Agreement is to enable Users to access the Marketplace and purchase Goods presented in the catalogue of https://dailydoll.shop.

3.2. This Agreement applies to all Goods and services presented on the Website while such offers remain available in the Marketplace catalogue.

3.3. DailyDoll Shop is a specialised marketplace for author dolls, collectible dolls, teddy bears, handmade toys, miniatures, accessories, workshops, patterns, digital files, and related creative products.

4. Registration on the Website

4.1. Registration on the Website is carried out through the registration form or other available registration tools.

4.2. Registration may be required to place Orders, open a shop, save account information, access digital files, or use certain Platform features.

4.3. The User is responsible for the accuracy, completeness, and relevance of the information provided during registration and use of the Website.

4.4. The User must not disclose their login and password to third parties. If the User suspects unauthorised access, they must immediately notify DailyDoll Shop at [email protected].

4.5. Communication between Users, Buyers, Sellers, support representatives, and other Platform participants must be respectful and lawful. Obscene language, threats, harassment, blackmail, discrimination, hate speech, and abusive conduct are prohibited.

4.6. Users must be at least 18 years old to use the Services independently. Minors aged 13 to 17 may use the Services only through an account owned and supervised by a parent or legal guardian. Children under 13 are not permitted to use the Services.

5. Goods and Order Procedure

5.1. Sellers are responsible for ensuring the availability, accuracy, legality, safety, and proper description of Goods presented on their Seller Pages.

5.2. Product photographs are illustrative and may differ slightly from the actual appearance of handmade, artistic, custom, or one-of-a-kind Goods.

5.3. Minor variations in colour, texture, material, shape, size, or artistic detail are normal for handmade and artistic items and are not automatically considered defects, provided that the Goods materially correspond to the description.

5.4. If ordered Goods are unavailable, the Seller may cancel the Order or exclude the unavailable Goods from the Order, notifying the Buyer by email or through the Platform.

5.5. If a fully or partially prepaid Order is cancelled due to unavailability of Goods, the amount paid for the cancelled Goods shall be returned to the Buyer using the original payment method unless otherwise required or permitted by law.

5.6. The Buyer is responsible for providing accurate order, contact, delivery, and payment information. Incorrect information may prevent proper fulfilment of the Order.

5.7. After placing an Order, the Buyer may receive information about expected processing and delivery times. Such information is generally provided by the Seller and may be approximate.

6. Delivery of Orders

6.1. Delivery methods, approximate delivery periods, and shipping costs are specified by the Seller or calculated during checkout where available.

6.2. Delivery terms may differ depending on the Seller, destination country, product type, carrier, customs rules, and selected shipping method.

6.3. Delivery delays may occur due to circumstances beyond the reasonable control of the Seller or Platform, including customs processing, postal delays, carrier delays, strikes, weather, force majeure, political events, or other external circumstances.

6.4. The Order may be delivered to the Buyer or another recipient specified by the Buyer. The Seller or carrier may request information necessary to identify the Order or recipient.

6.5. To prevent fraud and ensure proper delivery, the carrier or Seller may request identification from the recipient where permitted by law.

6.6. Risk of accidental loss or damage generally transfers according to applicable consumer law and delivery rules. For consumer Buyers, mandatory consumer protection rules apply.

6.7. If the Order is not delivered due to confirmed loss by the carrier or Seller fault, the Buyer may be entitled to a refund, replacement, Store Credit, or other remedy under the Return Policy and applicable law.

6.8. The delivery cost of each Order may be calculated individually based on Seller location, Buyer location, product weight, delivery method, carrier, customs requirements, and payment method.

6.9. The Seller’s delivery obligation is generally considered fulfilled when the Goods are delivered to the Buyer, recipient, postal office, pickup point, or other agreed delivery location, subject to applicable law.

6.10. Upon receipt, the Buyer should inspect the package and Goods as soon as reasonably possible. If the Goods are damaged, incomplete, incorrect, or visibly defective, the Buyer should document the issue with photos, videos, carrier documents, or other evidence and contact support.

6.11. If tracking information confirms that delivery was attempted, the parcel was available for pickup, the Buyer refused the parcel, the Buyer provided an incorrect address, or the Buyer failed to collect the parcel, the Buyer may be required to pay additional shipping costs for reshipment.

6.12. If the Buyer declines reshipment after failing to collect the package, the Seller or Platform may issue Store Credit instead of a monetary refund where permitted by law and Platform policy.

6.13. Delivery is a separate service from the Goods themselves. Claims related to Goods after delivery are handled according to the Return Policy, Seller terms, and applicable law.

7. Payment for Goods

7.1. Prices of Goods on the Website are generally displayed in euros (EUR), unless another currency is shown.

7.2. Prices may include VAT where the relevant Seller or Platform is required to apply VAT or similar taxes. Tax treatment may vary depending on Seller status, Buyer location, product type, and applicable law.

7.3. If the price of Goods is displayed incorrectly, the Seller or Platform may contact the Buyer to confirm the Order at the corrected price or cancel the Order. If the Order has already been paid and is cancelled, the paid amount will be refunded according to the applicable policy and law.

7.4. Sellers may change product prices unilaterally. Price changes do not affect Orders already confirmed, unless an obvious pricing error occurred and applicable law allows correction or cancellation.

7.5. Payments may be processed by third-party payment providers, including PayPal, Stripe, Apple Pay, Google Pay, banks, card networks, and other supported payment systems.

7.6. Bank card transactions must be performed by the cardholder or an authorised person. Payment providers and banks may refuse or review transactions suspected of fraud, abuse, sanctions violations, AML concerns, or regulatory issues.

7.7. To prevent fraud, the Seller, Platform, payment processor, or bank may request additional verification documents where permitted by law.

7.8. Sellers may offer discounts, bonuses, coupons, promotions, or loyalty benefits according to their own terms and Platform rules.

7.9. DailyDoll Shop may limit or restrict payment methods available to a Buyer based on fraud prevention, previous order history, risk review, payment processor rules, or other legitimate reasons.

7.10. Secure payment terms, payment processor rules, fees, and payout procedures are described in the Fees and Payments Policy and Payment Security Policy.

8. Returns, Refunds, Store Credit, and Digital Goods

8.1. Returns, refunds, replacements, re-shipping, Store Credit, and digital goods are governed by this Agreement, the Return Policy, Seller terms, and applicable law.

8.2. All return, refund, replacement, re-shipping, and Store Credit requests must generally be submitted within 180 calendar days from the date of purchase, unless mandatory law provides otherwise.

8.3. Monetary refunds may be available in cases involving:

  • Goods materially not as described;
  • incorrect item received;
  • damage in transit confirmed by evidence;
  • non-delivery not attributable to the Buyer;
  • defect or non-conformity covered by mandatory consumer law.

8.4. The Buyer must provide evidence where requested, including photos, videos, tracking screenshots, carrier documents, customs notices, or other relevant materials.

8.5. For discretionary returns based on personal preference, change of mind, colour perception, style, size, or non-defect-related dissatisfaction, Store Credit may be issued instead of a monetary refund where permitted by law.

8.6. Store Credit may be used toward future purchases on the Platform according to the terms of issuance. Store Credit may be non-transferable, non-cash, limited in time, and redeemable only once, unless otherwise required by law.

8.7. Custom-made, personalised, made-to-order, one-of-a-kind, or uniquely handmade items may be excluded from cancellation, withdrawal, or discretionary return rights where permitted by applicable law.

8.8. This exclusion does not affect the Buyer’s mandatory rights if Goods are defective, damaged, unsafe, or materially not as described.

8.9. Digital goods include downloadable files, patterns, templates, tutorials, workshops, instructions, digital art, and other digital content.

8.10. Digital goods are generally non-refundable once access has been provided or downloading has started, because they cannot be physically returned and may be copied, stored, or used immediately.

8.11. If a digital file is incorrect, corrupted, missing, or technically inaccessible due to Seller or Platform fault, the normal remedy is provision of the correct file, renewed access, replacement digital content, or technical assistance. A monetary refund is not the default remedy unless required by law.

8.12. The Buyer may retain access to purchased digital files for 12 months after purchase, unless otherwise stated in the listing or required by law.

8.13. Return shipping costs are generally paid by the Buyer for discretionary returns, unless otherwise agreed or required by law. If the return is caused by a proven defect, incorrect item, material non-conformity, or Seller error, return shipping costs may be handled according to applicable law and Platform decision.

9. Deposit Payments and Custom Orders

9.1. Sellers may request deposit payments for custom orders, reserved items, materials, production, or similar purposes.

9.2. Deposit terms must be clearly communicated and agreed with the Buyer before payment.

9.3. A deposit may be non-refundable where:

  • the Buyer clearly agreed to the non-refundable nature of the deposit;
  • the Seller has already purchased materials;
  • production has started;
  • the item was reserved specifically for the Buyer;
  • retention is proportionate and lawful.

9.4. Mandatory consumer protection law prevails over any deposit term.

9.5. If a non-refundable deposit is retained, the related amount may be blocked or held for up to 180 days from the date of payment to address possible disputes, chargebacks, fraud claims, or payment processor requirements.

10. Liability

10.1. Sellers are responsible for the quality, safety, legality, accuracy, packaging, and fulfilment of Goods they list and sell.

10.2. DailyDoll Shop does not manufacture, inspect, store, or guarantee all Goods sold by independent Sellers.

10.3. DailyDoll Shop is not responsible for damages caused by improper use of Goods by the Buyer.

10.4. DailyDoll Shop is not responsible for the content or functioning of external websites, third-party platforms, payment processors, carriers, or services outside its control.

10.5. DailyDoll Shop may assist Buyers in resolving claims against Sellers by providing available non-confidential information and support procedures.

10.6. Nothing in this Agreement excludes liability that cannot legally be excluded under applicable law.

11. Confidentiality and Data Protection

11.1. Personal data of Users, Buyers, and Sellers is processed according to applicable data protection laws, including GDPR, UK GDPR, Spanish data protection law, and other applicable privacy rules.

11.2. The processing of personal data is described in the Privacy Policy, which forms part of this Agreement.

11.3. During registration or order placement, the User may provide information such as name, contact phone number, email address, delivery address, billing information, date of birth where required, and other information necessary for account creation, order fulfilment, payment, delivery, support, verification, and legal compliance.

11.4. Personal data may be processed for:

  • account registration and management;
  • order processing;
  • delivery and shipping;
  • payment processing;
  • customer support;
  • fraud prevention;
  • legal and tax compliance;
  • marketing communications where permitted by law;
  • service improvement and analytics subject to applicable consent rules.

11.5. Marketing messages may be sent only where permitted by applicable law and subject to consent or opt-out rights. Service messages related to orders, payments, account security, legal notices, or policy updates may be sent where necessary and generally cannot be disabled.

11.6. The Website may use cookies and similar technologies according to the Cookie Policy. Where required by law, non-essential cookies are used only with consent.

11.7. DailyDoll Shop may receive information about IP addresses, device data, browser data, and technical logs for security, fraud prevention, analytics, and website operation.

11.8. Users are responsible for information they publish publicly on the Website.

11.9. Customer support communications may be recorded or stored where permitted by law for quality control, evidence, dispute resolution, fraud prevention, and service improvement.

12. Reviews and Ratings

12.1. Users may leave reviews, ratings, or comments in designated areas of the Website.

12.2. Reviews and comments are intended to provide other Users with opinions about purchased Goods, Seller reliability, and Marketplace experience.

12.3. Reviews may be moderated to detect unlawful, offensive, misleading, fraudulent, abusive, discriminatory, or irrelevant content.

12.4. DailyDoll Shop may reject, remove, edit, or limit reviews that violate law, this Agreement, Platform policies, or community standards.

12.5. Reviews must not contain obscene language, threats, hate speech, personal data, advertising, spam, external links, or content violating third-party rights.

12.6. Reviews that have been published may be removed or changed where required by law, Platform rules, fraud prevention, or mutual resolution of the parties.

12.7. Published reviews may be used by DailyDoll Shop for service improvement, promotional materials, newsletters, product pages, and Marketplace quality indicators, subject to applicable law and privacy rules.

12.8. Ratings may be generated automatically based on available criteria, including order history, reviews, delivery performance, disputes, and other marketplace signals.

13. Intellectual Property Rights

13.1. DailyDoll Shop owns or has rights to use the Website, platform, software, design, text, images, logos, trademarks, graphics, interfaces, databases, and other content necessary to operate the Marketplace.

13.2. Use of the Website does not transfer intellectual property rights to the User.

13.3. Users may use Website content only as permitted by this Agreement, Platform functionality, and applicable law.

13.4. If a User uploads or submits content to the Website, the User confirms that they own or have all necessary rights to such content and that it does not infringe the rights of third parties.

13.5. DailyDoll Shop may remove or restrict content that violates intellectual property rights or Platform policies.

13.6. Intellectual property complaints are handled according to the Intellectual Property Policy.

14. Seller Status, Fees, and Payouts

14.1. Sellers must comply with the Seller Policy, Seller Code of Conduct, Fees and Payments Policy, Delivery Policy, Return Policy, and all applicable laws.

14.2. DailyDoll Shop may offer subscription plans, promotional codes, listing limits, external advertising services, and other paid or free seller tools according to the current Fees and Payments Policy.

14.3. Seller commissions may include:

  • 23% commission for regular sellers;
  • 20% commission for Trusted Sellers who obtained or restored the status after March 1, 2025;
  • 15% commission for sellers who obtained Trusted Seller status before March 1, 2025, where applicable under current rules;
  • additional payment processing fees, bank fees, payout fees, or external advertising fees where applicable.

14.4. Payouts may depend on delivery confirmation, Seller verification, Trusted Seller status, payment processor rules, fraud prevention, and compliance checks.

14.5. Trusted Sellers may receive faster payouts and additional privileges according to the Trusted Seller Policy.

15. Additional Conditions

15.1. DailyDoll Shop may assign or transfer its rights and obligations under this Agreement where permitted by law.

15.2. The Website and Services may be temporarily unavailable due to technical maintenance, updates, security measures, hosting issues, or other operational reasons.

15.3. DailyDoll Shop may perform maintenance with or without prior notice.

15.4. Relations between Users, Buyers, Sellers, and DailyDoll Shop are governed by applicable European and Spanish law, without prejudice to mandatory consumer protection rights in the User’s country of residence.

15.5. Users should first submit questions, complaints, and claims to DailyDoll Shop support or the relevant Seller. The parties should attempt to resolve disputes through communication and negotiation.

15.6. If any provision of this Agreement is declared invalid or unenforceable, the remaining provisions remain valid and enforceable.

16. Governing Law and Jurisdiction

16.1. This Agreement is governed by the laws of Spain, unless mandatory consumer protection laws provide otherwise.

16.2. Where permitted by law, disputes involving DailyDoll Shop may be submitted to the competent courts corresponding to the company’s registered or operational location in Spain.

16.3. Consumers may also have the right to bring claims before competent courts or consumer protection bodies in their country of residence where mandatory law provides such rights.

16.4. Nothing in this Agreement limits non-waivable consumer rights.

17. Language

17.1. The official version of this Agreement is the English version unless another official language version is expressly designated by DailyDoll Shop.

17.2. Translations may be provided for convenience only.

17.3. In case of discrepancies between translated versions, the official version designated by DailyDoll Shop shall prevail, unless mandatory law requires otherwise.
