- Records and member information
Before contacting us for records or information, first check whether the information you are looking for is publicly available, or request records directly from the relevant Marketplace member.
Some information about buyers and sellers – (which we refer to as “Members”) and shops on our Marketplaces (which we refer to as “Stores”), such as the name of the shop, the publicly available name of its owner and shop policies, are publicly available and may be viewed by anyone at any time. In addition, members can access certain records by logging into their accounts. For example, sellers can access and upload sales records in .csv format, and all members can view their posting history by going to the appropriate pages in their Marketplace accounts.
- legal process
The legal process must contain sufficient identifying information for Marketplace to be able to identify the participant’s account. For example, a common name does not uniquely identify a member account. Your legal process should include information such as email address, transaction ID, username, shop name, or payment information. In addition, all law enforcement requests must identify the specific records requested and your request must include the name of the issuing authority and agent, an email address from the law enforcement domain, or a telephone number for direct contact.
- Provide a legal process for requesting access to participant information.
Check the location of the Participant whose information you are seeking before contacting the court. Requests for information relating to Participants should be directed to our Company’s registered office.
All requests for Participant Information should be made in accordance with current and sufficient legal procedures duly provided to us. We may be able to expedite your request if, in addition to providing us with proper legal services, you send a copy by email to [email protected].
- Emergency circumstances
If your request for information relates to an emergency involving a risk of death or serious injury to a Participant or any member of the public, send an email to [email protected] from your official email address and provide the following
Your name and title, the government agency you work for and your full contact details (government email address, telephone number and fax number);
A brief statement of the facts of the emergency, including how the situation poses a risk of death or serious injury to any person;
The identity of the person or people at risk;
The specific records required and how they relate to the emergency situation; and
Why a legal process cannot be obtained and why records must be disclosed without delay.
Persons with knowledge of the emergency should contact local law enforcement agencies immediately and directly.
- Notification to the Participant whose records are wanted
If possible, we may notify the Participant before disclosing records or requested information about them, unless it is prohibited by law or we have clear indications of illegal conduct and prior notification would be counterproductive. We may also give the participant sufficient time to appear and object to the proceedings in court if necessary.
- Requests for evidence
We usually object to requests for witnesses for trial or testimony. When we make records, we provide a standard declaration of authenticity from the custodian of the records. Witness statements from the custodian of record live are not necessary as the recordings are self-authenticating.
- Reimbursement of costs
We may seek reimbursement for our costs directly incurred in locating, assembling, collecting and preparing the records or information for production.
